The United States Court of Appeals Sixth Circuit is scheduled to hear Oral Arguments about the Great Lakes Fishing Decree Tuesday, December 10.
Those interested in the Great Lakes Fishing Decree on-going legal battles can listen to the Oral Arguments on the Court's website https://www.ca6.uscourts.gov/live-arguments at 1pm EST.
The Cases USA v. MI 23-1931 2:73-cv-00026 Western District of Michigan at Marquette with Judge P. Maloney. The Court description lists the following information:
- Plaintiff-intervenor Indian tribe appeals the district court's orders leading up to and including its adoption of the 2023 Great Lakes Fishing Decree, a negotiated settlement that apportions access to the Lake Michigan fishery among the State and several Indian tribes. (15 Minutes for Appellant; 15 Minutes to be Shared by Appellees) USA v. MI 23-1944 2:73-cv-00026 Western District of Michigan at Marquette.
- USA v. MI 23-1971 2:73-cv-00026 Western District of Michigan at Marquette. In these related matters, amicus sport fisherman's association appeals and the United States cross-appeals the district court's orders leading up to and including its adoption of the 2023 Great Lakes Fishing Decree, a negotiated settlement that apportions access to the Lake Michigan fishery among Michigan and several Indian tribes. (15 Minutes for Appellant; 15 Minutes to be Shared by Appellees)
While the losing side of these arguments may appeal to the U.S. Supreme Court, the Supreme Court receives thousands of petitions for review each year, but only agrees to hear about 2% of them or between 100 and 150 Cases. Therefore it is most likely that the decisions made by the Sixth Circuit Court of Appeals will decide the fate of the Great Lakes Fishing Decree BUT because of the importance of the case to the Sault Tribe we would expect they would try to protect our rights to the fullest extent if they lose their appeal.
